Will my boyfriend get deported to mexico?

my boyfriend and i were on our way back from ihop. we were just five minutes away from my house when a police followed and pulled us over. my boyfriend has a visa that is not expired yet but he does not have a ga license only a mexican one. the police officer explained that the reason for pulling him over was because one of his tail lights were off, we honestly did not know that his tail light had not been working or else we would have never gone out. he arrested my boyfriend who is 23 and said that the reason he is being arrested is for driving without a us license.i am a citizen but only have a permit so my parents had to come and pick me up while my boyfriend was in the police car with handcuffs. the police officer explained how we can bail him out tonight so that is what my parents are going to do. sad part is that we were thinking of getting married tomorrow. okay so my question is if he is going to get deported after he goes to court? i know it will be up to the judge and all but considering the immigration laws that are being passed i am really concerned about it. oh and btw the police officer never once said "you have the right to remain silent...." arent they suppose to say that as soon as they handcuff someone?
